Subsidiarität : Leerformel oder Orientierungshilfe zur Kompetenzverteilung in der EG?

Abstract

Das Subsidiaritätsprinzip ist zu einem Schlüsselbegriff in der europapolitischen Diskussion geworden. Allerdings ist der Begriff recht abstrakt und damit flexibel in der Interpretation. Bisher hat das Subsidiaritätspinzip mehr deklaratorischen Wert. Als Korrektiv einer zu starken Kompetenzausweitung der Gemeinschaft darf es nicht überschätzt werden,da die ökonomischen und politischen Voraussetzungen für seine praktische Umsetzung bisher kaum gegeben sind. Nach dem Subsidiaritätsprinzip müßte es in allen Mitgliedstaaten mehrere Entscheidungsebenen geben, jeweils mit legislativen und exekutiven Rechten und ausreichenden Finanzmitteln versehen. Bisher weist die EG aber nur preföderale Strukturen auf und ist von dem viel zitierten "Europa der Regionen" weit entfernt.
