La sélection du délégataire du service public: un libre choix encadré

Abstract

Le choix du délégataire du service public obéit en France à des règles profondément originales qui ne sont ni celles qui ont cours dans les rapports contractuels de droit privé, ni surtout celles qui s’imposent à l’administration lorsqu’elle recherche un partenaire pour exécuter un marché public. Il repose sur le principe de la liberté, mais d’une liberté encadrée. Dès lors, se posent plusieurs questions : Pourquoi choisir librement le délégataire du service public, c’est-à-dire le cocontractant de l'administration ? Cette règle a-t-elle un fondement juridique notamment en matière de droit des contrats ?
