Nová európska investičná politika a jej dopad na osud bilaterálnych investičných dohôd členských štátov EÚ (1. časť)

Abstract

Deklarovaným cieľom rozšírenia spoločnej obchodnej politiky EÚ patriacej do výlučnej kompetencie EÚ o investičnú politiku, ktoré priniesla Lisabonská zmluva, malo byť posilnenie pozície EÚ v rokovaniach o otázkach obchodnej politiky s kľúčovými svetovými partnermi. V skutočnosti sa tým narušilo relatívne stabilné investičné prostredie, ktoré bolo posledných 50 rokov v priestore EÚ podporené vytvorením siete početných bilaterálnych investičných zmlúv , ktorých budúcnosť sa stala v dôsledku uvedených zmien v európskej legislatíve otáznou. Úskalia postlisabonskej európskej legislatívy a ich dopad na budúcnosť existujúcich ako i novo uzatváraných medzinárodných dohôd obsahujúcich záväzky týkajúce sa ochrany investícií sú predmetom skúmania v tomto článku.
