Does recent government guidance clarify the uncertainty around the Minimum Energy Efficiency Standards (MEES) Regulations?

Abstract

Recent government guidance seeks to clarify some of the uncertainty regarding the Minimum Energy Efficiency Standards (MEES) Regulations. This paper considers the implications of the MEES Regulations and government guidance on those in the commercial property sector. It provides an overview of the MEES Regulations, including potential penalties, and considers potentially difficult situations which could impact those in this sector. It considers where government guidance addresses some of these difficult situations and where issues still remain. It includes a highlevel analysis of developments in the industry standard model commercial lease and the impact of the inclusion of certain contractual provisions to address the MEES Regulations.
