Verfahren zum Anleihekaufprogramm der EZB (2 BvR 859/15, 2 BvR 1651/15, 2 BvR 2006/15, 2 BvR 980/16): Stellungnahme zum Fragenkatalog für sachverständige Dritte

Abstract

Am 22. Januar 2015 entschied der Rat der Europäischen Zentralbank (EZB), das bisherige Ankaufprogramm von Wertpapieren (APP = Asset Purchase Programme) um Wertpapiere des öffentlichen Sektors (PSPP = Public Sector Purchase Programme) zu erweitern (EZB, 2015a). Im Rahmen des PSPP kaufen die nationalen Zentralbanken (NZB) anteilig gemäß ihrem Kapitalschlüssel, sowie die EZB selbst, seit März 2015 notenbankfähige Schuldverschreibungen von zulässigen Gegenparteien am Sekundärmarkt. Diese Entscheidung traf die EZB vor dem Hintergrund einer Reihe von Faktoren, die auf einen Anstieg der Abwärtsrisiken für die Preisentwicklung (Deflationsgefahr) in der mittleren Frist hindeuteten. Die Zunahme dieser Risiken gefährdete das durch das Mandat der EZB vorgegebene Ziel, Preisstabilität zu gewährleisten. Gründe dafür waren laut EZB unter anderem (EZB, 2015b): - Die unzureichende Wirkung des geldpolitischen Stimulus: Der Effekt der von der EZB bereits getroffenen Maßnahmen (Anleihekäufe im Unternehmenssektor sowie Zinssätze an der Nullzinsgrenze) fiel niedriger aus als zuvor erwartet. - Eine Abwärtsbewegung der meisten Indikatoren für die Preisentwicklung: Dies betraf die tatsächlichen wie die erwarteten Maße der Inflationsentwicklung im Euro-Raum sowie solche mit und ohne volatile Komponenten wie Lebensmittel und Energie (Kerninflation), die auf historische Tiefstände gefallen waren. - Der signifikante Rückgang des Ölpreises zwischen Dezember 2014 und September 2015: Aus Sicht der EZB drohte dadurch das Risiko von Zweitrundeneffekten bei der Lohn- und Preisbildung.
