Abstract

Резюме: Някои разпоредби на Закона за защита от дискриминация – чл. 36, чл. 50, т. 3, чл. 71, ал. 2 и ал. 3, чл. 72, чл. 76, ал. 1, които регламентират права на синдикалните организации, са свързани с упражняването на т. нар. колективни трудови права, включени в съдържанието на колективни трудови правоотношения или отношения, непосредствено свързани с трудовите. Първата разпоредба – чл. 36 се отнася към антидискриминационните аспекти на правото на синдикално сдружаване, докато останалите уреждат процесуални права на синдикалните организации при защита от дискриминация на работниците и служителите. Предмет на настоящия кратък юридически анализ е само правната норма на чл. 36 от закона.
