Abstract

"Preguntar cómo van las cosas y si pueden mejorar es una parte ineludible de la búsqueda de la justicia" [2012]. Esta reflexión de Amartya Sen orienta los tres contenidos del libro: 1. Permite comprender las condiciones en que opera el actual esquema de prestación del servicio de acueducto. 2. Justifica por qué la actual protección judicial otorgada por la Corte Constitucional, en los casos de suspensión del servicio, no es idónea. 3. Define una propuesta acerca de cómo el Estado ha de cumplir su deber de satisfacer la necesidad básica de acceso al agua potable. En suma, el autor justifica, de una manera novedosa, cómo el Estado ha de cumplir su deber de satisfacer la necesidad básica de acceso al agua potable, a partir de un exhaustivo estudio de caso en la jurisprudencia constitucional colombiana, la noción de necesidad básica, el concepto de derecho fundamental social de acceso al agua potable, y el enfoque de las capabilities desarrollado por Amartya Sen y Martha Nussbaum.
