Mietspiegel aus ökonomischer Sicht – Vorschläge für eine Neuregulierung

Abstract

In einem Rechtsstaat werden amtliche Statistiken grundsätzlich von neutralen Stellen errechnet. Im Gegensatz dazu unterliegt der Mietspiegel trotz seiner hohen Bedeutung für den Wohnungsmarkt zu einem großen Teil dem Gestaltungswillen lokaler Politiker und Interessensvertreter. Der Prozess seiner Erstellung bleibt zudem weitgehend intransparent. Im Ergebnis sind die durch Mietspiegel ausgewiesenen ortsüblichen Vergleichsmieten deutlich niedriger, als sie es nach aktuellen Marktbedingungen sein müssten. Dies widerspricht grundlegenden Prinzipien für amtliche Statistiken eines Rechtsstaates. Sofern eine Begrenzung der Miethöhe politisch erwünscht ist, sollte diese getrennt von der Erstellung des Mietspiegels umgesetzt werden. Um die Funktionsfähigkeit des Wohnungsmarktes aufrecht zu erhalten, muss der Mietspiegel wieder zu einem marktnahen Abbild des tatsächlichen Preisgefüges werden. Lerbs und Sebastian zeigen auf, welche Praktiken bei der Erstellung von Mietspiegeln zu einer Verzerrung der ortsüblichen Vergleichsmiete führen und wie dies zukünftig verbessert werden kann. Nur zum Teil ist dazu eine Änderung der aktuellen Rechtslage erforderlich.
