Rechtswirkungsforschung revisited: Stand und Perspektiven der rechtssoziologischen Wirkungsforschung

Abstract

Der Beitrag gibt einen Überblick über den Stand der Wirkungsforschung zum Recht. Ausgehend von der Bedeutung von Wirkungsanalysen für die politischadministrative Praxis erläutert er die Verfahren der prospektiven Gesetzesfolgenabschätzung und der ex-post Evaluation von Gesetzen. Anschließend wendet er sich der Frage nach dem Wert von Rechtswirkungsforschung als Grundlagenforschung zu. Dieser, so wird gezeigt, liegt in der Verknüpfung von empirischen Einsichten zur Wirkung und Wirksamkeit von Rechtsnormen auf der einen und vorsichtigen theoretischen Verallgemeinerungen auf der anderen Seite. Als Felder der Rechtswirkungsforschung werden die Implementationsforschung, die Mobilisierungsforschung sowie die Wirksamkeits-/Effektivitätsforschung dargestellt und erläutert. Der Beitrag argumentiert dafür, sich zukünftig weniger mit Ziel- und Kausalitätsfragen als vielmehr mit den (potentiellen) Wirkungsweisen unterschiedlicher Regelungsmodi zu befassen. Zuletzt werden die rechtlichnormativen Implikationen der Wirkungsanalyse aufgezeigt.
