Abstract

Die moderne Marktwirtschaft ist gekennzeichnet durch eine tendenzielle Entmaterialisierung der Produktion und einen steigenden Anteil immaterieller Leistungen im Handel. Der Wert von Gütern und Dienstleistungen wird zunehmend durch das in den Produkten enthaltene Wissen bestimmt. Vielfach ist gar von einem Wissenswettlauf die Rede, bei dem es darum geht, als Erster von allen Wettbewerbern die Lösung für ein bestimmtes Problem zu finden oder eine neue Technologie zu entwickeln. Durch Rechte des geistigen Eigentums kann Wissen grundsätzlich vor dem Missbrauch durch Dritte geschützt werden. Infolge des wachsenden Marktwertes von Wissen steigt der Bedarf an seinem Schutz. Seit den historischen Anfängen von Rechtssystemen, die zum Schutz geistigen Eigentums entwickelt wurden, schwelt jedoch die Kritik an diesen Rechten. Im Zusammenhang mit der aktuellen Diskussion um genetische Ressourcen erhält diese Kritik eine neue Dimension; die Legitimität ausschließlicher geistiger Eigentumsrechte auf die Verwertung genetischer Ressourcen wird in Frage gestellt.
