Abstract

De onderhavige notitie is oorspronkelijk geschreven als deskundigenrapport op verzoek van Knoops' Advocaten in het kader van de tegen de politicus Mona Keijzer ingediende aanklacht wegens groepsbelediging naar aanleiding van haar uitspraken in het televisieprogramma Sophie en Jeroen van 17 mei 2024. De aanklacht tegen Mona Keijzer werd op 11 juli 2024 door het Openbaar Ministerie geseponeerd. Het OM concludeerde dat de uitspraken van Mona Keijzer "op zichzelf beledigend" en "onnodig grievend" waren en dat zij zich daarmee "in beginsel schuldig heeft gemaakt aan groepsbelediging in de zin van artikel 137c Sr." De reden dat het OM toch tot seponering besloot over te gaan was gelegen in het feit dat zij deze uitspraken als politicus deed en de vrijheid van meningsuiting van politici in het kader van het publieke debat speciale bescherming geniet in het kader van artikel 10 van het Europees Verdrag voor de Rechten van de Mens. Tegen het sepotbesluit van het OM tekenden de klagers beroep aan bij het Gerechtshof Amsterdam. Het onderhavige rapport werd opgesteld op verzoek van de advocaat van mevr. Keijzer in het kader van deze zaak. Op 23 januari 2025 deed het Amsterdamse Gerechtshof uitspraak en wees het beklag tegen het sepotbesluit af. Anders dan het OM kwam het Gerechtshof tot de conclusie dat de uitspraken van mevr. Keijzer "niet onnodig grievend zijn" en daarmee ook niet strafbaar in de zin van artikel 137.
