Buon Governo e Giustizia. Gerechtigkeit - ein Qualitätsmerkmal des Regierens? Wolfgang Merkel zum 65. Geburtstag

Abstract

Der Beitrag geht der Frage nach, ob Gerechtigkeit ein Qualitätsmerkmal des Regierens ist. Durchforstet man die Literatur, finden sich viele Beiträge zum effizienten Regieren im Sinne von "governance capacity", zum guten Regieren als demokratischem Regieren, inklusive der Erfindung eines Demokratiebarometers, aber relativ wenig zu "Buon Governo e Giustizia". Das Problem der sozialen Ungleichheit wird vor allem als demokratiebedrohende Krankheit thematisiert, aber nicht als eine Frage gerechten Regierens. Demgegenüber geht der Beitrag unter Verwendung eines institutionentheoretischen Ansatzes der institutionellen Dimension von Gerechtigkeit nach und fragt nach der Existenz gerechter Institutionen. In diesem Zusammenhang kommen auch die Gerechtigkeitsgene des Rechtsstaates in den Blick; den Abschluss bilden Überlegungen zu Legitimitätsdiskursen als Gerechtigkeitsdiskursen.
