Solo-Selbstständigkeit in Deutschland

Abstract

Die soziale Sicherung der Solo-Selbstständigen in Deutschland stellt sich derzeit als lückenhaft dar. Eine der größten Herausforderungen besteht in der konkreten Ausgestaltung der Ausweitung der staatlichen Rentenversicherung auf alle Selbstständigen. Auch in anderen Sozialversicherungszweigen (Krankenversicherung, Arbeitslosenversicherung, Mutterschutz) bestehen akute Probleme, die Nachbesserungen bedürfen. Ziel von Reformen der sozialen Sicherung sollten dabei möglichst universelle Regelungen sein. Angestrebt werden sollte eine sozialversicherungsrechtliche Gleichbehandlung von Selbstständigen und abhängig Beschäftigten. Dadurch könnten Sicherungslücken aufgrund wechselhafter Erwerbsbiografien vermieden werden. Auch würde damit der Umstand berücksichtigt, dass eine klare Grenze zwischen abhängiger und selbstständiger Erwerbsarbeit immer schwerer zu ziehen ist und der Graubereich wächst. Weiterhin würde Anreizen entgegen gewirkt werden, abhängige Beschäftigung in selbstständige Tätigkeiten umzuwandeln, um dadurch Sozialversicherungsbeiträge zu sparen. Weiterer Reformbedarf besteht hinsichtlich der Existenzgründerförderung, des Arbeits- und Tarifrechts (insbesondere in Bezug auf Mindestlohnbestimmungen), des Arbeits- und Gesundheitsschutzes und der Mitbestimmung.
