Praxis und Wirkung des Mindestlohns

Abstract

Anlässlich der Anhörung des Bundestagsausschusses für Arbeit und Soziales zu Änderungen am Mindestlohngesetz und den arbeitsmarktpolitischen Auswirkungen des Mindestlohns zieht das Wirtschafts- und Sozialwissenschaftliche Institut (WSI) in der Hans-Böckler Stiftung eine positive Bilanz der Mindestlohneinführung. Gleichzeitig bedarf eine wirksame Umsetzung des Mindestlohngesetzes allerdings einer präziseren Definition der anrechenbaren Entgeltbestandteile und der Erfassung der tatsächlich geleisteten Arbeitsstunden. Hier besteht gegenüber der bisherigen Regelung nach wie vor ein Nachbesserungsbedarf. Besondere Bedeutung kommt außerdem der Kontrolle und Durchsetzung der Mindestlohnansprüche zu. Hierbei sollte die Last der Klage nicht alleine bei den einzelnen Beschäftigten liegen, sondern Gewerkschaften und Arbeitgeberverbänden ein Verbandsklagerecht eingeräumt werden, um wirksam gegen Mindestlohnverstöße vorgehen zu können
