Das Grünbuch zur Beschaffung nicht-sensitiver Rüstungsgüter

Abstract

Die EU-Kommission möchte den offensichtlichen Mißbrauch von Art. 296 EGV einschränken und so dafür sorgen, daß die Beschaffung von zivilen und Dual-use-Gütern sowie von nicht-sensitiven Rüstungsgütern durch die Verteidigungsbehörden vertragsgemäß im grenzüberschreitenden Wettbewerb erfolgt. Dazu hat sie im September 2004 ein Grünbuch vorgelegt. Die durch den Art. 296 EGV gedeckte Beschaffung sensitiver militärischer Ausrüstungsgegenstände ist hingegen nicht Gegenstand des Grünbuchs. Die Bundesregierung sollte nicht zuletzt auch zur Wahrung von Rechtssicherheit beide Vorschläge des Grünbuchs - auslegende Mitteilung und neue Vergaberichtlinie - unterstützen. (SWP-aktuell / SWP)
