Rechtssicherheit im Auslandseinsatz: Zum völkerrechtlichen Charakter des Einsatzes der Bundeswehr in Afghanistan

Abstract

Die Situation in Afghanistan sei nicht als Krieg einzustufen, die Bundeswehr befinde sich dort in einem Stabilisierungs-, nicht in einem Kampfeinsatz - so die lange Zeit vorherrschende offizielle Sprachregelung. Der Bundesminister der Verteidigung, Karl-Theodor Freiherr zu Guttenberg, spricht jetzt von »kriegsähnlichen Zuständen« und davon, dass in Teilen Afghanistans ein »nichtinternationaler bewaffneter Konflikt« ausgetragen werde. Das Bemühen um klare Worte und trennscharfe Begrifflichkeiten ist keinesfalls nur ein Gebot eindeutiger Kommunikation. Es geht vor allem darum, ein Höchstmaß an Rechtssicherheit für die Soldaten im Einsatz zu schaffen. Dies erfordert zuallererst eine präzise völkerrechtliche Einordnung der Konfliktlage
