Gefahrenabwehr auf See: Piraterie an der Küste Somalias - nationale und internationale Antworten

Abstract

Spätestens seit der Entführung des Lübecker Frachters MV Lehmann Timber wird die Debatte über Piraterie auch in Deutschland geführt. Insbesondere die Küste Somalias steht dabei im Schlaglicht, da hier eine der wichtigsten Schifffahrtsrouten vorbeiführt und die meisten Angriffe zu verzeichnen sind. Zudem patrouilliert dort die deutsche Fregatte Emden im Rahmen der Anti-Terroroperation Enduring Freedom (OEF). In mindestens drei Fällen musste sie in diesem Jahr bereits Schiffen bei Angriffen durch Piraten zu Hilfe kommen. Eine neue UN-Sicherheitsratsresolution bevollmächtigt Kriegsschiffe nun erstmals, in das Hoheitsgebiet eines Staates vorzudringen, um Piraten aktiv zu bekämpfen. Ob die deutsche Marine von dieser neuartigen Befugnis Gebrauch machen darf, ist verfassungsrechtlich noch zu klären. Überdies erscheint fraglich, ob ein robustes Mandat zur Bekämpfung der Piraterie an der somalischen Küste den dortigen Problemen gerecht wird
