Negative Sanktionen und auswärtige EU-Migrationspolitik: "Less for less" führt nicht zum Ziel

Abstract

Die EU-Kommission hat angekündigt, während der deutschen EU-Ratspräsidentschaft einen neuen 'Pakt für Migration und Asyl' zu präsentieren. Erwartet werden Impulse für die lang ausstehende Reform des Gemeinsamen Europäischen Asylsystems, eine Stärkung der EU-Außengrenzen und die migrationspolitische Kooperation mit Drittstaaten. Letzteres sehen viele Staaten der EU als besonders dringlich an, um Herkunftsländer zur Rückübernahme ausreisepflichtiger Staatsbürger zu bewegen. Neben posi­tiven Anreizen werden zunehmend Sanktionsmöglichkeiten gegenüber kooperationsunwilligen Drittstaaten diskutiert. Zwar können Strafmaßnahmen kurzfristig wirken, erscheinen aber wenig nachhaltig und gefährden weitergehende Ziele der Europäischen Außen- und Entwicklungspolitik. Daher sollte sich Deutschland während seiner Rats­präsidentschaft eher für migrationspolitische Instrumente einsetzen, die einen langfristigen und fairen Interessenausgleich der EU mit Drittstaaten zum Ziel haben.
