Die EU-Dienstleistungsrichtlinie: Neue Wege europäischer Gesetzgebung

Abstract

Die lange umstrittene europäische Dienstleistungsrichtlinie war wohl das brisanteste politische Gesetzgebungsprojekt der letzten Jahre. Sie sorgte für erhitzte Debatten in den Parlamenten und für Massendemonstrationen, und nicht zuletzt wurde die sogenannte »Bolkestein-Richtlinie« dafür verantwortlich gemacht, dass das Referendum über den Europäischen Verfassungsvertrag in Frankreich scheiterte. Mit der Abstimmung im Europäischen Parlament am 15. November 2006 wurde nun dieses vielleicht wichtigste wirtschaftspolitische Projekt der EU abgeschlossen. Der Verlauf des Gesetzgebungsverfahrens und die dabei aufgebrochenen Konfliktlinien zwischen Befürwortern einer weiteren Marktöffnung und Anhängern des europäischen Sozialmodells könnten geradezu exemplarisch werden für eine sich abzeichnende Umverteilung der Rollen der am europäischen Rechtssetzungsprozess beteiligten drei Organe, des Parlaments, des Rats und der Kommission.
