Der Internationale Strafgerichtshof und das Verbrechen der Aggression: Durchbruch auf der Überprüfungskonferenz in Kampala?

Abstract

Am 31. Mai 2010 beginnt in Kampala die erste Konferenz zur Überprüfung des Statuts des Internationalen Strafgerichtshofs. Eines der wichtigsten Anliegen besteht darin, das Verbrechen der Aggression im Statut zu definieren und die Bedingungen festzulegen, unter denen der Gerichtshof seine Jurisdiktion im Hinblick auf dieses Verbrechen ausüben kann. Auf der Gründungskonferenz von Rom konnte 1998 keine Einigung über eine Regelung dieser Punkte im Statut erzielt werden. Nach jahrelangen intensiven Verhandlungen liegen nunmehr konkrete Textentwürfe vor, die eine Grundlage bilden sollen, um diesen Prozess erfolgreich abzuschließen. Einer der Hauptstreitpunkte ist nach wie vor, ob und in welchem Umfang dem Sicherheitsrat der Vereinten Nationen die Möglichkeit eingeräumt werden soll, auf Verfahren vor dem Gerichtshof Einfluss zu nehmen, die mit staatlichen Aggressionshandlungen im Zusammenhang stehen
