Deutsche Integrationsbremsen: Folgen und Gefahren des Karlsruher Urteils für Deutschland und die EU

Abstract

Das Bundesverfassungsgericht hat am 30. Juni 2009 mit seinem »Ja« zum Vertrag von Lissabon die Forderung verbunden, die Beteiligungsrechte von Bundestag und Bundes-rat an der Fortentwicklung des europäischen Integrationsprozesses zu stärken. Für alle Fälle eines vereinfachten Verfahrens zur Änderung oder Anpassung des Lissabonner Vertrages bedürfe es einer gesetzlichen Regelung der Beteiligungsrechte. Das Gericht hat sein Urteil genutzt, um die für Deutschland bestehenden politischen und rechtlichen Grenzen des europäischen Integrationsprozesses grundsätzlich neu zu definieren, indem es die Bereiche unantastbarer Gestaltungshoheit des nationalen Gesetzgebers benennt. Damit verkürzt das Gericht die europapolitische Integrationsverantwortung von Bundestag und Bundesrat auf die Überwachung der europapolitischen Entscheidungen der Exekutive und setzt den Akzent der parlamentarischen Mitwirkung an der Europapolitik auf die Einhegung qualitativer Integrationsschritte
