Extraterritoriale US-Sanktionen: Nur US-Gerichte können den weltweiten Vollzug nationalen Rechts wirksam begrenzen

Abstract

Die unilateralen Sanktionen der Vereinigten Staaten beeinträchtigen natürliche und juristische Personen überall auf der Welt. Bei dem Versuch, in der EU ansässige Unternehmen vor den nachteiligen Wirkungen dieser Sanktionen zu schützen, haben sich außenpolitische Entscheidungsträger in Europa hilflos gezeigt. Um diesem Ziel zumindest mittelfristig näher zu kommen, sollten sich die Europäer nicht allein auf das Streben nach mehr strategischer Autonomie verlassen, sondern vorhandene Einflusskanäle besser nutzen. Eine Möglichkeit bestünde darin, europäische Unter­nehmen diplomatisch und finanziell dabei zu unterstützen, vor US-Gerichten die Administration beim Vollzug nationaler Gesetze außerhalb der eigenen Landes­grenzen einzuschränken.
