Die Multinationale Truppe im Irak: Völkerrechtlicher Status nach der Machtübergabe

Abstract

Mit Beendigung der Besetzung und mit Übergabe der vollständigen Regierungsgewalt an eine souveräne Interimsregierung hat am 28. Juni, zwei Tage früher als erwartet, offiziell die erste Phase des politischen Übergangs im Irak begonnen. Während der Übergangsperiode soll eine vom UN-Sicherheitsrat mandatierte und bereits seit längerer Zeit vor Ort stationierte Multinationale Truppe zusammen mit irakischen Kräften für die Aufrechterhaltung von Sicherheit und Stabilität sorgen. Die völkerrechtlichen Rahmenbedingungen für den Einsatz dieser Truppe waren bis zuletzt nicht im Detail geklärt. Einige wichtige Entscheidungen zum künftigen Status der Truppe - insbesondere zur Frage der Immunität gegenüber der irakischen Gerichtsbarkeit - wurden erst am Tag vor der Machtübergabe getroffen.
