Die EU-Konfliktmineralienverordnung - ein Probelauf für verantwortungsvolle Beschaffung im Rohstoffsektor?

Abstract

Seit dem 1. Januar 2021 müssen Unternehmen, die bestimmte mineralische Rohstoffe in die EU einführen, dafür sorgen, durch ihre Beschaffungspraktiken nicht zu Konflikten und Menschenrechtsverletzungen beizutragen. Damit endet die Übergangsfrist der 2017 veröffentlichten EU-Verordnung zu Konfliktmineralien, die in der EU erstmals verbindliche menschenrechtliche Sorgfaltspflichten für Unternehmen einführt. Ihr Anwendungsbereich ist allerdings äußerst eingeschränkt. Die Umsetzung kann jedoch als Probelauf gesehen werden, aus dem Lehren für die Einführung von umfassenderen Regulierungen im mineralischen Rohstoffsektor sowie von unternehmerischen Sorgfaltspflichten in anderen Wirtschaftssektoren abgeleitet werden können.
