Kostentragung und Arbeitsbefreiung bei Weiterbildung von Aufsichtsratsmitgliedern

Abstract

Um den ständig wachsenden Anforderungen an die Aufsichtsratsarbeit gerecht zu werden und ihren Sorgfaltspflichten - die auch eine Pflicht zur Fort- und Weiterbildung umfassen - nachzukommen, sind Arbeitnehmervertreter*innen darauf angewiesen, auch unternehmensexterne, ggf. entgeltliche Weiterbildungsangebote wahrzunehmen. Das vorliegende Rechtsgutachten zeigt auf, wann Unternehmen zu einer Kostenübernahme und zur entgeltlichen Freistellung von Arbeitnehmervertreter*innen im Zusammenhang mit Fort- und Weiterbildungsveranstaltungen verpflichtet sind.
