EU-domstolen BLIR nagelprovet: Undergräva eller stärka medbestämmanderätten

Abstract

- EG-domstolen har med stöd av en tolkningsfråga från en tysk domstol till uppgift att besluta om huruvida den existerande lagstiftningen om arbetstagarnas medbestämmanderätt i företagsorgan resp. lagstiftningens tillämpning är förenlig med EU-lagstiftningen. - Beroende på EG-domstolens beslut hotas de nationella systemen av allvarliga störningar i arbetsmarknadsrelationerna i samtliga medlemsländer. Målet har därför mycket stor betydelse inte bara för Tyskland. - Regeringarna i EU:s medlemsländer kan delta i målet inför EG-domstolen med egna ställningstaganden. - De nationella fackföreningsorganisationerna bör utifrån dessa aspekter undersöka om det är meningsfullt att verka för att deras egna regeringar lämnar in ett eget ställningstagande.
