Test décsif auprès e la CJUE: La cogestion en sortira-t-elle affaiblie ou renforcée?

Abstract

- La CJUE doit décider, sur la base d'une question posée par un tribunal allemand, si les lois existantes sur la participation des travailleurs aux organes des entreprises, ou leur application, est compatible avec le droit européen. - Selon son issue, la décision que prendra la CJUE risque d'entraîner des distorsions considérables des systèmes nationaux de relations industrielles dans l'ensemble des Etats membres. En conséquence, la procédure est d'une importance capitale, au-delà de l'Allemagne. - Les gouvernements des Etats membres de l'UE peuvent participer à la procédure devant la CJUE en présentant leur propre position. Les fédérations syndicales nationales devraient vérifier s'il est judicieux, du fait des considérations mentionnées, d'intervenir auprès de leurs gouvernements nationaux respectifs, pour les inciter à remettre leur propre position.
