Mitbestimmungsfeindlicheres Klima: Unternehmen nutzen ihre Freiheiten - Arbeitnehmer werden um ihre Mitbestimmungsrechte gebracht

Abstract

- Mitbestimmung der Arbeitnehmer im Aufsichtsrat ist in Deutschland ein gesetzliches Recht. Auch in mittelgrosen Unternehmen mit mehr als 500, aber weniger als 2000 Beschaftigten mussen ein Drittel der Sitze im Aufsichtsrat mit Vertretern der Arbeitnehmer besetzt sein. - Eine neue empirische Studie zeigt jetzt: Nur ca. 50% der hiervon betroffenen GmbH kommt dieser gesetzlichen Bestimmung nach. Arbeitnehmer werden so um ihre Mitbestimmungssrechte gebracht. - Die Nicht-Anwendung von Mitbestimmungsgesetzen und die Umgehung der Mitbestimmung durch Nutzung von Gesetzeslücken im deutschen Mitbestimmungsrecht sowie von Moglichkeiten der europaischen Rechtslage bilden ein mitbestimmungsfeindliches Klima. - Es ist hochste Zeit, dass dem politisch entschieden entgegen gearbeitet wird. Sonst ist der Vorteil der Mitbestimmung fur die Wirtschaft in Deutschland verspielt.
