Les jeux sont faits - Eine ordnungspolitische Analyse des Glücksspielstaatsvertrages von 2021

Abstract

Am 1. Juli 2021 trat ein neuer Glücksspielstaatsvertrag (GlüStV) für Deutschland in Kraft. Nach Jahren juristischer Auseinandersetzungen und offensichtlicher wirtschaftspolitischer Misserfolge soll dieser endlich eine ordnungspolitisch sinnvolle und rechtlich zuverlässige Basis für die verschiedenen Formen des Glücksspiels in Deutschland garantieren. Dieser Beitrag gibt einen Überblick über den Glücks- spielmarkt und erklärt die bisherigen Ansätze zur Regulierung vor dem Hintergrund ordnungspoliti- scher Grundsätze. Zum Schluss wird der neue GlüStV kritisch begutachtet: Es zeigt sich, dass viele ökonomische und juristische Fehlentwicklungen im neuen GlüStV tatsächlich behoben worden sind, einige regulatorische Problemfelder aber dennoch fortbestehen.
