Lehren aus Schengen: Der Besitzstand einer verstärkten Zusammenarbeit

Abstract

Der Schengen-Besitzstand ist ein komplexes rechtliches Konstrukt, dessen präzise Definition eine Herausforderung darstellt. Fragen betreffend die Abgrenzung des Besitzstands stellen sich jedoch nicht bloß in Zusammenhang mit der Verstärkten Zusammenarbeit im Bereich Schengen, sondern auch generell im Hinblick auf dieses Instrument der differenzierten Integration. Vor diesem Hintergrund befasst sich der vorliegende Beitrag mit dem Besitzstand einer Verstärkten Zusammenarbeit im Allgemeinen und nimmt eine grundsätzliche Bestimmung ebendieses Besitzstands vor. Hierauf aufbauend werden zudem die Besonderheiten analysiert, welche im Zusammenhang mit dem Schengen-Besitzstand bestehen. Die Untersuchung ergibt, dass der Besitzstand einer Verstärkten Zusammenarbeit sämtliche Rechtsakte i.S.v. Art. 288 AEUV umfasst, die in einem bestimmten - wenngleich variablen - Themenbereich situiert sind. Diese Rechtsakte weisen zudem besondere Eigenschaften auf.
