Zur falschen Zeit am falschen Ort? Administrative Ungleichbehandlung in der deutschen Justiz und Verwaltung

Abstract

Deutschland steht, wie andere Staaten auch, vor der Herausforderung, dass politische und gesellschaftliche Präferenzen der Bevölkerung regional stark variieren. Der Föderalismus gilt oft als geeigneter Ansatz, um mit dieser Heterogenität umzugehen. Unsere Forschung identifiziert jedoch eine problematische Seite dieses Organisationsprinzips: die administrative Ungleichbehandlung von Migrant:innen in Bundesländern und Kommunen. Dieses Paper erörtert, inwiefern administrative Ungleichheit den Gleichbehandlungsgrundsatz untergräbt und so den liberalen Rechtsstaat schwächt. Anhand von Gerichts- und Verwaltungsentscheidungen zu Asylgesuchen, Einbürgerungen und Sanktionen zeigen wir die administrative Ungleichbehandlung an Behörden und Gerichten auf. Wir schließen mit Empfehlungen zu deren Abbau
