Concurrence normative en Europe: Quelle attractivité pour les droits nationaux?

Abstract

This paper traces the origins of regulatory competition in the economic analysis of law and confronts the predominantly North American economist discourse with the European integrationist one. Regulatory competition, deriving from utilitarian concepts, still exists in the European Union. However, the dialectic between harmonization of law and autonomy of Member States reduces the scope of this economic competition. Moreover, it raises questions about the emergence of a concept of attractiveness of national laws not exclusively based on economic values.
