Abstract

يناقش هذا البحث أساساً موضوعين مهمين في المعاملات المالية المعاصرة يختص الأول ببيان مسائل بيع العين الغائبة على الصفة وأحوال الثمن والمثمن فيه. بينما يركز الثاني على الموصوف في الذمة، ويتعرض بالتفصيل لقضية مهمة تتعلق بتأجيل البدلين أو عمارة الذمتين، صوراً، وأحكاماً، وبياناً للإجماع الذي حكي في المسألة، مع التوجيه المناسب له. معتمداً في كل ذلك نقل أقوال أهل العلم وآرائهم ومذاهبهم ومقولات المعاصرين من الفقهاء والاقتصاديين. ثم يتناول بعض التطبيقات المعاصرة في المعاملات المالية مثل: عقد التوريد، وأسواق السلع، وبيع الدين.
