Abstract

Le contrôle de l’utilisation d’Internet par les salariés est légitime et n’est pas toujours illégal. Sa mise en oeuvre demande la plus grande prudence ; elle peut donner lieu à des infractions pénales d’atteinte à la vie privée des salariés. L’auteur n’est pas toujours l’employeur qui pourra être qualifie de complice, mais celui qui commet les faits : en pratique le directeur informatique ou autre cadre de l’entreprise chargé de la mise en oeuvre du contrôle. les possibilités d’être exonéré de sa responsabilité pénale sont limitées. quelques précautions à prendre : ne pas commettre d’infraction ; faire consulter le comite d’entreprise. The control of the use of Internet by workers is legitimate and is not always illegal. The greatest caution is needed for its implementation; it may have as a consequence an attempt to the private life of workers. The responsible is not always the director who may be qualified as an accomplice, but the one who commits the facts: in the practice, the information system manager or another manager of the entreprise in charge of the implementation of the control. The ways to be exonerated of penal responsabilities are limited. Some precautions to take: avoid from making an infraction, ensuring consultation of the joint production committee
