Abstract

While the Trans-Pacific Partnership (TPP) has seen some rough sailing with the United States' withdrawal, it remains the acknowledged state of the art for current economic cooperation agreements, and it stands out as the first of its kind as a megaregional agreement. This article reviews and analyzes investor protection clauses of the original TPP in the context of Philippine policy concerns and the attempt of the TPP's provisions to both enhance and balance investor protection with good governance in the areas of environment and labor regulations.
