Evaluating the ‘new culture’ of human rights in European Private Law

Abstract

This paper serves as an editorial to a collection of papers on the horizontal effect of fundamental rights in private law in the European Union. The papers refer to developments in several European jurisdictions, and cover a broad range of topics, from environmental rights to linguistic rights, from conditional bequests to consumer rights, from the right to adopt to the right to know one’s own genetic origins. This collection of papers forms a special issue of the European Review of Private Law, and presents some of the results of a project entitled ‘Fundamental Rights and Private Law in the European Union’, funded as a Research Training Network under the European Community’s Fifth Framework Programme. The editorial discusses the aims and results of this research project, and introduces the papers selected for this special issue.
