Abstract

Penerapan konsep pemerintahan yang baik merupakan kebutuhan mutlak bagi rakyat, demi terciptanya suatu sistem politik pemerintahan yang berpihak kepada kepentingan rakyat sesuai dengan prinsip-prinsip demokrasi secara umum. Berkaitan dengan perkembangan pembangunan sarana dan prasarana untuk kepentingan umum yang semakin meningkat, dimana memerlukan tanah sebagai subyek utamanya telah menimbulkan persoalan atau konflik karena kepentingan umum dengan kepentingan perorangan. Kondisi seperti ini diperlukan adanya upaya pengaturan yang bijaksana dan adil. Hal ini menyangkut tentang pengambilan tanah milik masyarakat yang akan digunakan untuk kegiatan pelaksanaan pembangunan pemerintahan. Pengaturan dan pengelolaan pertanahan di bidang pengadaan tanah bagi pembangunan untuk kepentingan umum, harus dilaksanakan dengan menggunakan prinsip-prinsip kemanusiaan, demokratis dan adil.
