Tinjauan Islam Terhadap Hak Seorang Istri Setelah Jatuh Talak

Abstract

Penelitian ini di latar belakangi oleh kasus yang sering terjadi dimasyarakat pada umumnya. Seorang suami yang telah menalak istri dan kurang memperhatikan kewajibannya untuk memberikan nafkah terhadap istrinya, sehingga istri tersebut tidak mendapatkan haknya setelah ditalak. Penelitian ini merupakan penelitian kepustakaan (library research) dan metode penafsiran maudhu’i (tematik) dengan mengkaji dari beberapa kitab tafsir di antaranya tafsir Ibnu Katsir, tafsir Al-Mishbah, tafsir Al-Jalalain, tafsir Al-Munir dan tafsir Al-Wajiz. Hasil Penelitian ini menunjukkan bahwa seorang suami tetap berkewajiban untuk menafkahi istri yang sudah di talaknya. Terlebih jika seorang istri sedang hamil maka suami mempunyai tanggung jawab untuk memberikan tempat tinggal yang baik dan nafkah sampai ia melahirkan. Sebagaimana Allah SWT berfirman “tempatkanlah mereka, para istri di mana kamu bertempat tinggal, yakni di tempat tinggal kamu yang layak menurut kemampuan kamu, dan janganlah kamu menyusahkan mereka, para istri untuk menyempitkan hati dan perasaan mereka.”
