Abstract

Agama Islam sebagai agama yang universal dan sebagai way of life, mengatur gejala-gejala baru yang timbul di masyarakat. Salah satu masalah ekonomi Islam kontemporer adalah pengembangan alat pembayaran non tunai, khususnya e-money. Kehalalalan penggunaan uang elektronik masih diragukan oleh masyarakat. Karena wujudnya yang tidak tampak hanya berapa nomor, dan berupa kode digital pada sebuah chip atau server. Ini bertujuan untuk mencari common value dan posisi uang elektronik. Faktanya e-money itu seperti kartu debit, karena uangnya yang digunakan dalam uang elektronik adalah uang konsumen, tidak disertai utang dengan riba, maka status penggunaan uang elektronik sebenarnya adalah kontrak “hawalah”. Uang elektronik dalam akad “hawalah”.bisa disebut “muhal bih” (piutang dialihkan). Dengan demikian, penerbitan kartu yang berfungsi sebagai uang seperti ini diperbolehkan oleh hukum syariah. Sehingga biaya administrasi dan pembuatan kartu, diperbolehkan juga. Selain itu juga, tidak ada “gharar” dalam uang elektronik ini.
