Keyfi Ve Dikkatsiz Söylemler Soykırım Teriminin Hukuki Tanımını Ve İçeriğini Yozlaştırıyor

Abstract

Savaşın yol açtığı korkunç ıstıraba paralel olarak, Ukrayna'da işlenen savaş suçlarına ilişkin son derece ağır iddialar dile getirilmekte ve bu iddialar giderek daha fazla geçerlilik kazanmaktadır. Son dönemde bazı ülke liderleri tarafından "soykırım" teriminin sıklıkla kullanıldığı ve önde gelen uluslararası medya kuruluşlarının da işlendiği iddia edilen savaş suçlarına ilişkin olarak, bu terimi kamuoyuna benimsetecek şekilde yayın yaptığı görülmektedir. Yahudi kökenli Polonyalı bir avukat olan Raphael Lemkin, bu terimi 1944'te ortaya atmıştır. Soykırım Sözleşmesi aşındırılmamalı ve katı bir yasal tanımı olan soykırım terimi rastgele kullanılmamalıdır. Fransa Cumhurbaşkanı Emmanuel Macron'un Ukrayna'daki savaş suçları iddialarına ve bu iddialara istinaden kullanılan soykırım tabirine ilişkin ifadeleri oldukça şaşırtıcıdır. Bu konudaki görüşlerini French Blue radyo kanalına verdiği bir röportajda dile getirmiştir. Macron, bu konuyla ilgili şu görüşü dile getirmiştir “Soykırım sözcüğü politikacılar tarafından değil, hukukçular tarafından tanımlanmalıdır.” Emmanuel Macron’un soykırım tanımı konusunda bu kez sorumlu bir devlet adamına yakışır bir açıklama yaptığı görülmektedir. Macron, soykırım tanımını 1948 Soykırım Sözleşmesi hükümlerine göre yorumlayarak gerçeği bulmak yolunda önemli bir adım atmış gibi görünmektedir.
