Abstract

Dalam Islam kedudukan harta merupakan hal penting yang dibuktikan bahwa terdapat lima maqashid syariah yang salah satu diantaranya adalah al-maal atau harta. Islam meyakini bahwa semua harta di dunia ini adalah milik Allah ta’ala, manusia hanya berhak untuk memanfaatkannya saja. Meskipun demikian, Islam juga mengakui hak pribadi seseorang. Untuk itu Islam mensyariatkan peraturan-peraturan mengenai muamalah speperti jual beli, sewa-menyewa, gadai menggadai, dan sebagainya, serta melarang penipuan, riba dan mewajibkan kepada orang yang merusak barang orang lain untuk membayarnya, harta yang dirusak oleh anak-anak yang di bawah tanggungannya, bahkan yang dirusak oleh binatang peliharaannya sekalipun.
