Analisis Praktik Akad Ijarah Mausufah Fi Adz-zimmah dalam Bisnis Kontemporer

Abstract

Seperti yang kita ketahui kegiatan jual beli di masa sekarang sudah menggunakan teknologi modern, baik itu lewat media sosial atau aplikasi-aplikasi layanan online, sehingga transaksi-transaksi yang dilakukan lebih mudah dan sangat praktis contohnya memesan barang atau jasa, tetapi banyak dari mereka yang belum mengetahui apakah transaksi tersebut sudah sesuai dengan hukum islam atau belum? Didalam transaksi tersebut juga terdapat mengandung unsur-unsur penipuan, agar kita tidak mudah tertipu, di dalam artikel ini penulis akan membahas tentang praktik akad ijarah mausufah fi adz-zimmah dalam bisnis kontemporer sesuai syariat islam. Salah satu penerapan nya ada pada sewa jasa atau manfaat barang melalui pembayaran gojek (Go-Pay) secara tunai, apakah transaksi ini sudah sesuai dengan syariat islam atau mengandung gharar? Karna sebagian ulama memiliki perbedaan pendapat terkait hukum mengenai pembayaran ujrah atau upah dalam akad ini. Jika dasar hukum yang dipakai hukum salam pada akad ini maka upah yang dibayar harus dilakukan secara tunai pada saat akad, sedangkan jika dasar hukum ijarah yang dipakai maka pembayaran imbalan jasa dapat dilakukan di akhir atau ditangguhkan sebagaimana akad ijarah lainnya.
