NSU Davası Sonuçlandı Ve Hukuki Olarak Kapatıldı: Davanın Toplumsal Ve Siyasi Yansımalarından Kaçınmak Mümkün Mü?

Abstract

Neo-Nazi Nasyonal Sosyalist Yeraltı (NSU) terör örgütü, 2000-2007 yılları arasında Almanya'da on kişiyi öldürmüştü. Kurbanların sekizi, Almanya'da yaşayan üç milyondan fazla kişiden oluşan Türk toplumuna mensuptu. Nasyonal Sosyalist Yeraltı Örgütü- NSU'nun elebaşları, Beate Zschäpe, Uwe Mundlos ve Uwe Böhnhardt idi. Bunlardan ikisi, Uwe Mundlos ve Uwe Böhnhardt, operasyonlarda kendilerini öldürdü. NSU davası başladığında NSU'nun hayatta kalan tek çekirdek kadro üyesi Beate Zschäpe idi. Beate Zschäpe ile birlikte, NSU üçlüsünün yakın çevresinde olduğu düşünülen Ralf Wohlleben ve André Eminger dahil olmak üzere dört şüpheli suç ortağı yargılanarak çeşitli derecelerde hapis cezalarına çarptırıldı. Almanya'nın en yüksek temyiz mahkemesi olan Federal Adalet Mahkemesi, 19 Ağustos 2021 tarihinde Beate Zschäpe ve diğer iki hükümlü suç ortağı tarafından yapılan temyiz başvurusunu reddetmişti. Federal Mahkeme, kısa süre önce Andre Eminger'in 2018 yılında aldığı iki yıl altı aylık hafifletilmiş hafif hapis cezasını onadı. Böylece, Münih Mahkemesinin hükmü, bu kararla tamamen hukuki açıdan bağlayıcı hale gelmiştir. Yüksek mahkemenin, Münih Mahkemesinin kararına yönelik görüşlerinde herhangi bir hukuki hata veya boşluk bulmadığı ve temyiz başvurusunu reddettiği anlaşılmaktadır. NSU neo-Nazi terör hücresinin ortaya çıkmasından on yıl sonra, Almanya Federal Adalet Mahkemesi'nin bu kararıyla, NSU davası hukuken sonuçlandı ve bütünüyle kapatıldı. Daha önceki analizlerimizde, ırkçılık, yabancı düşmanlığı ve İslamofobi’nin Almanya'da artmakta olduğunu ve AVİM olarak bu gerçeği endişe verici bir gelişme olarak gördüğümüzü belirtmiştik. NSU cinayetleriyle ilgili mahkeme kararlarının bütününün, ırkçılık, yabancı düşmanlığı ve İslamofobi’nin Almanya'da hak ettiği cezayı görmediği ve NSU örgütünün gerçek boyutlarının kasten açıklığa kavuşturulmadan bırakıldığı yönündeki algıyı güçlendirdiğinin altını çizmeliyiz.
