Abstract

Penerapan kaidah fikih pada kegiatan muamalah dapat membantu menemukan dan menyelesaikan masalah. Dalam salah satu penerapan al-qawā’id al-fiqhiyyah adalah akad musyarakah di perbankan syariah. Dengan kaidah laa dharar wa laa dhirar, dalam kerjasama usaha, kaidah ini menjadi prinsip disetiap perjanjian yang dibuat yang didasari pemahaman Islam, baik dalam perbankan maupun di ekonomi secara luas. Penyusunan artikel ini menjelaskan tentang memecahkan masalah-masalah pembagian pembiayaan di perbankan syariah dengan menerapkan kaidah fikih yaitu dengan akad musyarakah. Dengan begitu terdapat akad yang adil pada kerjasama usaha yang dilakukan oleh pihak bank dan nasabah.
