Abstract

Seiring perkembangan zaman dan teknologi di era digital saat ini semua kehidupan masyarakat mulai bergantung pada teknologi. Kegiatan yang biasanya dilakukan secara langsung kini dapat dilakukan secara online, salah satu contohnya adalah interaksi jual beli melalui aplikasi E-Commerce. Kemudahan jual beli tersebut sangat dirasakan secara signifikan oleh pembeli dan penjual. Namun, hal ini membuat para pelaku bisnis banyak melakukan pelanggaran-pelanggaran terhadap merek dagang tanpa ijin dari pemilik merek tersebut yang dijual dengan harga murah untuk mendapat keuntungan. Dompet palsu yang dijual di Shopee merupakan salah satu contoh nyatanya. Koleksi dompet yang ditawarkan cukup menarik dengan model dan warna yang dibuat sama persis seperti merek dompet ternama di dunia dengan harga yang terjangkau. Pelaku usaha yang melakukan pelanggaran merek terdaftar dalam perdagangan transaksi elektronik (e-commerce), dalam bentuk persamaan secara keseluruhan, persamaan pada pokoknya, dan dilusi dapat diterapkan ketentuan pasal 100 ayat (1) dan ayat (2) UU No.20 Tahun 2016 tentang Merek Dan Indikasi Geografis. Metode yang digunakan dalam penelitian ini adalah metode deskriptif. Metode ini bertujuan untuk membuat deskripsi atau gambaran mengenai fakta-fakta, sifat-sifat serta hubungan antar fenomena yang diselidiki.
