Abstract

Masalah pemerintahan berdasarkan kajian Hukum Tata Pemerintahan dapat dilihat dari kedudukan pemerintah sebagai penguasa yang diberikan legitimasi untuk mengatur dan memerintah dari pemegang kekuasaan tertinggi atau rakyat dan selanjutnya dimaknai sebagai yang diperintah. Asas legalitas yang mendasari legitimasi kekuasaan adalah prinsip utama sebagai dasar penyelenggaraan pemerintahan dan kenegaraan yang berdasarkan hukum. Penyelenggaraan pemerintahan dan kenegaraan dalam negara hukum berdasarkan undang-undang, serta terdapatnya jaminan hak dasar rakyat, dan asas legalitas merupakan dasar legitimasi tindakan pemerintah dan jaminan perlindungan hak rakyat. Keputusan dari pemerintah dalam upayanya mengatur dan mengarahkan serta menyelesaikan masalah-masalah pemerintahan yang diartikan sebagai tindakan pemerintahan.
