Perlindungan Hukum bagi Investor saat Covid-19 pada Perseroan Terbatas yang Pailit

Abstract

Penelitian ini membahas tentang perlindungan hukum terhadap investor yang perseroan terbatas nya pailit saat pandemi covid-19. jenis penelitian yang digunakan dalam penelitian ini yaitu normatif dengan menggunakan sumber data yaitu buku-buku literatur dan peraturan undang -undang yang berlaku. Dalam penelitian ini, menggunakan metode analisis data secara kualitatif dengan mengumpulkan data yang kemudian diolah menjadi sebuah hasil penelitian. Hasil penelitian dapat disimpulkan bahwa investor menjadi kreditur konkuren dalam mendapatkan ganti rugi atau pemenuhan hak nya pada saat perseroan terbatas pailit saat pandemi covid-19. Hal ini menunjukkan bahwa perlindungan terhadap investor yang perseroan terbatas nya pailit saat pandemi covid-19 masih kurang dan belum ada jaminan hukum yang jelas untuk melindungi investor. Hal ini diperlukan sebagai upaya untuk memberikan informasi kepada masyarakat untuk menilai sekuritas yang diterbitkan dan dijual oleh PT yang bersangkutan dan dapat juga mengajukan gugatan terhadap perseroan ke pengadilan negeri yang diatur dalam pasal 61 ayat (1) Undang-Undang Perseroan Terbatas apabila terdapat tindakan perseroan yang dianggap tidak adil terhadap pemegang saham.
