Asuransi dalam Tinjauan Fiqh Kontemporer Studi Kasus : BPJS

Abstract

BPJS adalah jaminan kesehatan yang disediakan pemerintah kepada masyarakat, seluruh WNI dianjurkan untuk memiliki kartu tersebut. Yang jadi permasalahan adalah adanya kerguan dalam cara kerja BPJS, apakah caranya dibolehkan oleh islam atau tidak. Penelitian ini bertujuan agar mengetahui hukum BPJS sebagai asuransi, apakah islam membolehkannya. Metode yang akan digunakan adalah istinbath hukum fiqih berupa library research dengan mengumpulkan data dari penelitian sebelumnya, menggunakan metode tafsir maudhui dengan mencari solusi dari ayat Al-Quran yang membahas hal serupa. Hasil dari penelitian ini adalah bahwa hukum BPJS tidak dobolehkan sebab mengandung unsur ghoror dan maisir.
