Abstract

Menjawab tantangan global, jual beli valuta asing (valas) tidak dapat terelakkan, namun transaki tersebut masih meragukan kesyari’ahannya dalam pandangan hukum muamalah, sehingga membutuhkan pengkajian sesuai dengan landasan al-qur’an dan al-hadits. Menurut jumhur ulama dan fatwa Dewan Syariah Nasional Majelis Ulama Indonesia, jual beli valas (al- sharf) dibolehkan dengan ketentuan sesuai dengan syarat-syarat jual beli pada umumnya, tidak untuk spekulasi, ada kebutuhan transaksi atau untuk berjaga- jaga, dilakukan dengan at-taqabudh (secara tunai dan nilainya sama untuk barang sejenis), dan bila tidak sejenis maka harus sesuai dengan nilai kurs saat transaksi dilakukan dan secara tunai.
