Analisis Yuridis Kekosongan Hukum (Rechtvacuum) Dalam Eksekusi Aset Kepailitan Lintas Batas (Cross-Border Insolvency) Di Indonesia

Abstract

Mekanisme globalisasi ekonomi dan digitalisasi korporasi memicu peningkatan transaksi komersial lintas batas negara yang berimplikasi pada kompleksitas perkara kepailitan. Masalah mendasar muncul ketika debitur pailit memiliki aset yang terfragmentasi di luar yurisdiksi nasional. Penelitian hukum normatif ini bertujuan untuk menganalisis kekosongan hukum (rechtvacuum) akibat rigiditas asas teritorialitas yang dianut dalam Undang-Undang Nomor 37 Tahun 2004 tentang Kepailitan dan PKPU (UU KPKPU) serta urgensi kodifikasi UNCITRAL Model Law on Cross-Border Insolvency. Hasil penelitian menunjukkan bahwa Pasal 212 UU KPKPU tidak memiliki daya eksekusi (enforceability) di luar negeri karena keterbatasan kedaulatan teritorial. Dampaknya, kurator domestik mengalami hambatan dalam melakukan pemberesan harta (boedel) pailit yang berada di yurisdiksi asing seperti Singapura. Penelitian ini merekomendasikan restrukturisasi hukum melalui adopsi asas universalitas terbatas ke dalam legislasi nasional guna menjamin asas paritas creditorium.
